Terms of Service

Effective Date: January 1, 2026

1. Acceptance of Terms

By accessing or using Logystera products or services, you agree to these Terms. If acting on behalf of a company, you represent that you are authorized to bind that entity.

2. Services Provided

Logystera provides software and tooling for processing JSON logs, extracting metrics, applying rules, and delivering observability and alerting. Additional services may be offered under separate agreements.

3. Customer Responsibilities

  • Provide accurate information.
  • Use the services legally and responsibly.
  • Control and manage any data transmitted to Logystera.
  • Not misuse or attempt unauthorized access to systems.

4. Intellectual Property

All software, designs, documentation, and branding remain the property of Logystera. You may not copy, modify, or redistribute without explicit permission.

5. Liability

Logystera is provided “as is” unless covered by a separate contract. We are not liable for loss resulting from customer misconfigurations, third-party failures, or use outside documented guidance. Liability is limited to the maximum extent permitted by law.

6. Termination

We may suspend or terminate service for violations of these Terms or failure to pay. You may stop using the service at any time.

Service Level Agreements

For paid subscription tiers, Logystera provides the following support commitments:

Standard Support
(Included with all paid plans)
  • Business hours coverage (9 AM - 5 PM CET, Monday-Friday)
  • 24-hour initial response time for support requests
  • Best-effort resolution for non-critical issues
Priority Support
(Available as add-on)
  • 24/7/365 coverage
  • 4-hour response time for critical issues
  • 12-hour response for high-priority issues
Dedicated Support
(Available as add-on)
  • Named support engineer
  • 1-hour response time for critical issues
  • 4-hour response for high-priority issues
  • Monthly review calls

Uptime Commitments

Note: Uptime commitments apply to cloud-hosted deployments via API Gateway.

  • Starter: 99.0% uptime
  • Professional: 99.5% uptime
  • Enterprise: 99.9% uptime with custom SLA available

On-premises deployments: Uptime is customer's responsibility. We provide support for troubleshooting and optimization.

Refund Policy

Monthly Subscriptions

  • No refunds for partial months
  • Cancellation takes effect at end of current billing period
  • Access continues through paid period

Annual Subscriptions

  • Pro-rated refund available within first 30 days
  • After 30 days: No refunds, cancellation applies to next renewal
  • Unused months are forfeited upon cancellation

Implementation Services

  • 50% refund if cancelled before work begins
  • Pro-rated refund based on milestones completed
  • No refund once final deliverables are accepted

Limitation of Liability

Our liability to you is limited to:

  • Subscription fees: Fees paid in the 12 months preceding the claim.
  • Implementation services: Fees paid for the specific engagement.
  • Maximum cap: $100,000 or fees paid (whichever is greater).

Exceptions

Liability limits do not apply to:

  • Gross negligence or willful misconduct.
  • Data breaches caused by our security failures.
  • Violations of intellectual property rights.
  • Death or personal injury.

DISCLAIMER: Logystera is provided "as is" for development and testing. Production deployments are covered by specific service agreements with defined SLAs and liability terms.

Data Ownership & Portability

Your Data

  • You retain all rights to your log data and generated metrics.
  • Logystera claims no ownership of customer data.
  • You may export your data at any time.
  • Upon termination, we assist with data migration for 30 days.

Our Intellectual Property

  • Logystera software, documentation, and branding remain our property.
  • You receive a license to use (not own) during subscription.
  • License terminates upon subscription end.

Your Custom Configuration

  • YAML configuration files you create are your property.
  • Custom rules and metrics you develop are your intellectual property.
  • You may reuse your configurations with other tools.

Export Compliance

Logystera complies with applicable export control regulations including:

  • U.S. Export Administration Regulations (EAR)
  • EU Dual-Use Regulation
  • International sanctions programs

Prohibited Use

You may not use Logystera:

  • In embargoed countries (Cuba, Iran, North Korea, Syria, Crimea).
  • By prohibited parties or sanctioned entities.
  • For weapons development or proliferation.
  • In violation of any applicable export laws.

Customers are responsible for compliance with export laws in their jurisdiction.

Governing Law & Dispute Resolution

Governing Law

  • EU customers: Croatian law (jurisdiction: Commercial Court in Zagreb).
  • US/Canada customers: As specified in subscription agreement.
  • Other customers: To be specified in subscription agreement.

Dispute Resolution Process

  1. Good-faith negotiation (30 days)
  2. Mediation (if negotiation fails)
  3. Binding arbitration (if mediation fails)
  4. Right to pursue injunctive relief in courts for urgent matters
